1. Acceptance of Terms

By creating an account, accessing, or using DeclassifAI, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Service.

You represent that you are of legal age to form a binding contract and are not prohibited from using the Service under applicable laws.

2. Description of Service

DeclassifAI provides an AI-powered platform for automated detection and redaction of sensitive information in documents. The Service processes documents using machine learning models to identify and redact sensitive data categories including personal information, financial data, health information, and other protected categories.

DeclassifAI is provided as a Software-as-a-Service (SaaS) platform with both free and paid subscription tiers, offering various features including multiple AI detection models, manual redaction tools, and document management capabilities.

3. Account Registration & Security

To access certain features of DeclassifAI, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account credentials
• Immediately notify us of any unauthorized use of your account

4. Acceptable Use Policy

You agree not to use DeclassifAI to:

• Violate any applicable laws, regulations, or third-party rights
• Process documents you do not have the legal right to access or modify
• Attempt to reverse engineer, decompile, or extract source code from our Service
• Interfere with or disrupt the Service or servers/networks connected to the Service
• Use automated systems to access the Service in a manner that sends more requests than a human can reasonably produce
• Resell, sublicense, or provide access to the Service to third parties without authorization

5. User Responsibilities & Data Handling

By using DeclassifAI, you acknowledge and agree that:

• You are responsible for the content of all documents you upload and process
• You will verify all automated redactions before using or distributing redacted documents
• You understand AI detection models may produce false positives (incorrect identifications) and false negatives (missed sensitive information)
• You will not rely solely on automated detection and will conduct manual review as appropriate for your use case

6. Intellectual Property Rights

DeclassifAI is developed by Safe Media AI AS and incorporates both proprietary technology and open-source components. All intellectual property rights in the Service, including software, algorithms, user interface, and documentation, remain the property of Safe Media AI AS and its licensors.

You retain all rights to the documents you upload. By using the Service, you grant DeclassifAI a limited license to process your documents solely for the purpose of providing the Service. Documents are encrypted before backend processing and immediately deleted after processing completion.

Certain components of DeclassifAI use open-source software. These components are licensed under their respective open-source licenses, which are available upon request.

7. Privacy & Data Processing

DeclassifAI is designed with privacy as a core principle. Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

For information about your data protection rights under GDPR, CCPA, and other privacy regulations, please see Sections 12 and 13 below and consult our Privacy Policy.

8. Service Availability

We strive to provide reliable service but do not guarantee that DeclassifAI will be available at all times or free from errors. The Service may be subject to limitations, delays, and other issues inherent in internet and electronic communications.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, for maintenance, updates, or other reasons.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Service will be uninterrupted, error-free, or completely secure
• Warranties regarding the accuracy or reliability of AI detection results
• Warranties that all sensitive information will be detected or redacted

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY NORWEGIAN LAW, DECLASSIFAI, Safe Media AI AS, AND OUR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

(a) your use or inability to use the Service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any errors or omissions in detection or redaction; (d) any data breaches or security incidents; or (e) any other matter relating to the Service.

11. Indemnification

You agree to indemnify, defend, and hold harmless DeclassifAI, Safe Media AI AS, and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. GDPR Compliance (European Union Users)

For users in the European Economic Area, DeclassifAI processes personal data in accordance with the General Data Protection Regulation (GDPR). You have the following rights:

• Right of Access: Request copies of your personal data
• Right to Rectification: Request correction of inaccurate personal data
• Right to Erasure: Request deletion of your personal data
• Right to Restrict Processing: Request limitation of processing of your personal data
• Right to Data Portability: Request transfer of your data to another organization

13. CCPA (California Users)

California residents have specific rights under the California Consumer Privacy Act (CCPA), including:

• Right to Know: Request information about the personal information we collect and how it is used
• Right to Delete: Request deletion of your personal information
• Right to Opt-Out: Opt-out of the sale of personal information (Note: DeclassifAI does not sell personal information)

14. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Trondheim, Norway.

15. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a prominent notice on the Service at least 30 days before the changes take effect.

Your continued use of DeclassifAI after changes to the Terms constitutes acceptance of the revised Terms.
